What these Terms cover, and what they do not
These Terms apply to the Website only: the pages you are reading, our published guides and the forms you may submit.
They do not govern the Niyam product. If you create an account - including a free one - your use of the product is governed by the Niyam Terms of Service, the associated Data Processing Agreement and the applicable refund and cancellation terms, which you accept during sign-up. Those documents, not these Terms, define the service, the commitments and the commercial relationship. You can read them at niyam.flickerbytes.com/terms, /privacy, /refund and /legal. Where those terms and these Terms conflict in relation to the product, those terms prevail.
Using the Website
You may use the Website for lawful, informational purposes. You agree not to misuse it, probe or disrupt it, attempt to gain unauthorised access to it, or use it in any way that breaches applicable law. If you wish to conduct security testing against anything we operate, contact us first and obtain written authorisation.
Intellectual property
The content of the Website - text, graphics, layout, and the FlickerBytes and Niyam names and logos - is owned by or licensed to FlickerBytes and protected by applicable law. You may not reproduce or redistribute it without our permission, beyond normal personal or internal business reference.
Our content is information, not advice
Our guides, checklists, framework summaries and the DPDP guide are general information. They are not legal, regulatory or professional advice, and no lawyer-client or advisory relationship arises from reading them. Compliance obligations depend on your circumstances; obtain advice specific to your organisation before acting.
No warranties
The Website and its content are provided "as is" and "as available". To the extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Website will be uninterrupted or error-free, or that its content is complete or current.
Limitation of liability
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- wilful misconduct or gross negligence; or
- any other liability that cannot lawfully be excluded or limited.
Subject to that, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, goodwill or data, arising from your use of or inability to use the Website.
Nothing in these Terms affects any statutory right you have that cannot be excluded or limited by agreement, including rights under the Consumer Protection Act, 2019 where it applies to you.

The Website links to third-party sites, including our own product at niyam.flickerbytes.com. We are not responsible for the content or practices of sites we do not operate.
Changes to these Terms
We may update these Terms. For material changes we will update the "last updated" date above and give reasonable prominence to the change on the Website before it takes effect. Continued use after a change takes effect means you accept the updated Terms.
General
- Severability. If any provision is held invalid or unenforceable, it is severed or read down to the minimum extent necessary, and the remainder continues in full force.
- Entire agreement. These Terms are the entire agreement between you and us in relation to the Website, and replace any earlier understanding about it.
- Assignment. You may not assign or transfer your rights under these Terms. We may assign ours to an affiliate or in connection with a merger, acquisition or sale of assets.
- Force majeure. Neither party is liable for failure or delay caused by events beyond its reasonable control.
- Termination. We may suspend or withdraw all or part of the Website at any time. Provisions that by their nature should survive - intellectual property, disclaimers, limitation of liability and governing law - survive.
- No waiver. A failure to enforce a provision is not a waiver of it.
Governing law and jurisdiction
These Terms are governed by the laws of India, and the courts at Hyderabad, Telangana have exclusive jurisdiction over any dispute arising from them.
If you are a consumer resident outside India, this does not deprive you of the protection of mandatory consumer-protection rules of your country of residence, or of the right to bring proceedings in your local courts where the law of that country gives you that right.
